Deciding
0 of 4
-
A general ban in a standard-form lease is void, but a weighing in each case decides (BGH, VIII ZR 168/12).
-
Animal Welfare Dog Ordinance § 2: exercise, contact with the carer and contact with other dogs, adapted to breed, age and health.
-
The municipality sets the dog tax. A reserve for vet costs helps: the site’s emergency fund calculator shows how long it lasts.
-
The states and municipalities regulate this differently: Hamburg two weeks, Berlin one month for registration.
Finding the animal
0 of 3
-
The Federal Ministry warns about illegal puppy trade: the animals are often too young, weakened and unvaccinated.
-
It may only be separated from its mother at over eight weeks (Animal Welfare Dog Ordinance § 2(4)).
-
For travel in the EU, dogs, cats and ferrets need a chip, a rabies vaccination and an EU pet passport (BMLEH).
Registering and insuring
0 of 5
-
Berlin: within a month, registration in the dog register also counts as the tax one. Hamburg: within two weeks (Service Berlin, hamburg.de).
-
In Hamburg all dogs must carry a microchip from the third month of life (hamburg.de).
-
In some states it is mandatory (Hamburg: at least 1 million euros, at most €500 excess). Personal liability insurance does not cover dogs (Verbraucherzentrale).
-
Cats, rabbits and other small animals are generally covered (Verbraucherzentrale).
-
State governments can require this for areas with many free-living cats (Animal Welfare Act § 13b).
At home
0 of 5
-
Water must be available to the dog at all times in sufficient quantity (Animal Welfare Dog Ordinance § 8).
-
Tethering is forbidden, with narrow exceptions when accompanied by a carer (§ 7).
-
This is forbidden (Animal Welfare Dog Ordinance § 2(5)).
-
The vet writes the vaccinations in the vaccination record or the EU pet passport.
-
The ordinance requires regular contact with other dogs, except for health reasons or incompatibility (§ 2).
Everyday life
0 of 4
-
In Hamburg a general leash requirement applies, with exemptions (hamburg.de); elsewhere states and municipalities regulate it differently.
-
Even without fault (BGB § 833; Verbraucherzentrale).
-
Whoever finds an animal must report the find to the competent authority or the owner (BGB § 965).

Good to know
- The rules for dogs are state and municipal law: registration, dog tax, chip, leash and liability insurance differ from place to place. Hamburg and Berlin serve here as examples; ask your municipality.
- The Animal Welfare Dog Ordinance gives no fixed number of hours for exercise: it must be sufficient and suit the dog’s breed, age and health.
- Animals are not things (BGB § 90a): whoever torments or neglects them risks a fine, and for cruelty or prolonged suffering a penalty (Animal Welfare Act §§ 17 and 18).
- Cats, unlike dogs, are generally covered by personal liability insurance; check your policy.
Frequently asked questions
Can my landlord ban a dog or cat?
A general ban in a standard-form lease is void. Whether keeping one is allowed is decided by weighing the interests of the landlord, the residents and the neighbors in each case (BGH, judgment of March 20, 2013). Clarify it before getting the animal.
Where do I register my dog?
With the municipality or, where it exists, in the dog register: in Berlin within a month, in Hamburg within two weeks. That usually registers the dog tax as well.
Do I need dog liability insurance?
In some states yes (in Hamburg with a sum insured of at least a million euros), elsewhere only for certain dogs. Personal liability insurance does not cover dogs, and the keeper is liable even without fault: dog liability insurance is strongly recommended.
From what age can I take a puppy home?
A puppy may only be separated from its mother at over eight weeks (Animal Welfare Dog Ordinance § 2(4)).
What do I do if I find an animal?
Report the find to the owner if you know them, otherwise to the competent authority, without delay (BGB § 965). The lost-property office or the shelter helps further.
