Spain early lease termination (desistimiento) calculator
Whether you can leave the flat, how much notice you must give and how much the compensation would be if the lease provides for it.
Compensation for terminating
€3,066.67
46 months to go: 3.83 months’ rent
- 3.83 months’ rent
- Notice of 30 days
- Six months completed
If your lease provides for the compensation of article 11, at one month’s rent for each year remaining and the proportional share of shorter periods, with 46 months to go (3 years and 10 months) that is 3.83 months’ rent of €800.00: €3,066.67.
You must have completed at least six months of the lease and give the landlord a minimum notice of 30 days.
- The law allows this compensation to be agreed: one month’s rent for each year remaining. What your lease says prevails within that limit; read the clause before giving notice.

How it works
- The tenant may terminate the lease once at least six months have passed, by notifying the landlord with a minimum notice of thirty days (article 11 of the LAU).
- The parties may agree in the lease that the tenant compensates the landlord with one month of the rent in force for each year of the lease remaining; periods shorter than a year give rise to the proportional share.
- The calculator multiplies the rent in force by the years left until the end of the agreed term (months ÷ 12). If the lease does not provide for compensation, the law does not impose it.
Worked example
A rent of €800 and 46 months to go (3 years and 10 months): 800 × 46 / 12 = €3,066.67, if the lease provides for the compensation. With 12 months to go it would be €800; with 6, €400.

Good to know
- The calculator uses the months left until the end of the agreed term. A lease extended by law (article 9) may give a different result: ask a tenants’ association or a lawyer if in doubt.
- It does not include what you may already owe: back rent, the deposit, damage or pending charges.
- The lease cannot make your situation worse than the law: clauses that change the residential lease rules to the tenant’s detriment are void, unless the law itself allows it (article 6 of the LAU).
- If the lease does not provide for compensation, you can still terminate after six months with thirty days’ notice.
Frequently asked questions
When can the tenant leave the flat early?
Once at least six months of the lease have passed, and by giving the landlord at least thirty days’ notice (article 11 of the LAU).
Do I have to pay compensation for terminating?
Only if the lease provides for it: the law allows agreeing one month’s rent for each year remaining, with the proportional share of shorter periods.
How is the proportional share calculated?
One month’s rent per year: with six months to go, half a month; with 46 months, 46/12 months’ rent.
What if I give less than thirty days’ notice?
The law requires a minimum of thirty days’ notice: with less, the termination does not meet article 11. Give notice in writing and keep proof.
