The gross is what the contract says; less reaches your account. See the guide “From gross salary to net”.
-
The agreement can improve on what the law sets. The Ministry of Labor has the register of agreements and a map to guide you.
-
If it is temporary, it is only valid for production circumstances or replacement, and the cause must be in the contract (Workers’ Statute, art. 15).
-
Without an agreement, up to 6 months for qualified technicians and 2 for the rest (3 in firms with under 25 people); in temporary contracts of up to 6 months, 1 month (Workers’ Statute, art. 14).
-
Under 16 work is forbidden, and up to 18 some jobs are barred (Workers’ Statute, art. 6).

The company must apply for it with the contract, and without it you cannot work (Organic Law 4/2000, art. 36).

Good to know
- The rules in this list apply to people working as employees in Spain. For domestic service, public employment and other special regimes the rules are partly different.
- The payslip changes from month to month: extra payments, overtime, arrears and changes in your family situation move the net. The withholding is not the final tax: it is adjusted in the tax return.
- What the collective agreement sets weighs heavily: probation period, leave, hours and payments can be better than the legal minimum.
Frequently asked questions
Do I have to sign a written contract?
Not always: it can be made verbally, but it must be in writing in the cases the law sets (for example, temporary contracts of more than four weeks) and either party can demand the written form at any time (Workers’ Statute, art. 8).
How long can the probation period last?
Without an agreement saying otherwise, up to 6 months for qualified technicians and 2 months for the rest, which is 3 in firms with under 25 workers; in temporary contracts of up to 6 months, 1 month. It must be in writing, and it is void if you had already done the same duties at the company (art. 14).
Who registers me with Social Security?
The company, before you start: it must request affiliation and report the registration. If it does not, you can request it yourself directly from Social Security (General Social Security Law, art. 139).
What is deducted from my payslip?
Social Security contributions, which in 2026 are 6.50% of the base on a permanent contract, and the IRPF withholding, which depends on your salary and family situation. The company also pays its own contributions.
